Waiver and Assumption of Risk Agreement
In consideration of ME/THE MINOR being permitted to participate in any way in Pulse Performance Training sponsored activities "the Activity", I agree:
I understand the nature of Pulse Performance Training activities and believe I/THE MINOR am qualified to participate in such Activity. I further acknowledge that I am aware the activity will be conducted in facilities open to the public during the Activity. I further agree and warrant that if at any time I believe conditions to be unsafe, I will immediately discontinue further MY/THE MINOR'S participation in the activity.
I FULLY UNDERSTAND that (a) Pulse Performance Training Activities involve risks and dangers of SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS, AND DEATH ("Risks"); (b) these Risks and dangers may be caused by ME/THE MINOR'S own actions, inactions, the actions or inactions of others participating in the Activity, the condition in which the Activity takes place, or THE NEGLIGENCE OF THE "RELEASEES" NAMED BELOW; (c) there may be other risks and social and economic losses either not known to ME/THE MINOR or not readily foreseeable at this time; and I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES incurred as a result of MY/THE MINOR'S participation in the Activity.
I HEREBY RELEASE, DISCHARGE, COVENANT NOT TO SUE, AND AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS PULSE PERFORMANCE TRAINING, their respective administrators, directors, agents, officers, volunteers, and employees, other participants, and sponsors, advertisers, and if applicable, owners and lessors of the premises on which the Activity takes place (each considered one of the "Releasees" herein) from all liability, claims, demands, losses, or damages on MY/THE MINOR'S account caused or alleged to be caused in whole or in part by the negligence of the 'Releasees" or otherwise, including negligent rescue operations and further agree that if, despite this release, I/THE MINOR, or anyone on my behalf makes a claim against any of the Releasees names above, I WILL INDEMNIFY, SAVE AND HOLD HARMLESS EACH OF THE RELEASEES FROM ANY LITIGATION EXPENSES, ATTORNEY FEES, LOSS LIABILITY, DAMAGE OR COSTS ANY MAY INCUR AS THE RESULT OF SUCH CLAIM.
I am aware that PULSE PERFORMANCE TRAINING may record or photograph workouts or MYSELF/THE MINOR individually for use on television segments, website marketing, promotional materials, or before and after pictures. By signing this document, I hereby authorize PULSE PERFORMANCE TRAINING to use MY/THE MINOR'S name, likeness, voice, and verbal statements, videos or pictures for any purpose.
I am aware that PULSE PERFORMANCE TRAINING has a strict Code of Conduct and has zero tolerance for any behavior or language in regard to drugs and/or alcohol, guns and/or violence, radicalism, racism, sexually explicit material, politically charged material, and sexual harassment or abuse of any kind. When non-compliance with our Code of Conduct is reported or otherwise suspected, steps wil be taken to investigate and, if appropriate, remedy the situation immediately. I am aware that if I/THE MINOR violates the Code I/THE MINOR will be subject to disciplinary action, up to and including dismissal from the program.
